a dutch man died here in Philippines and he is married to a filipina,how can the widow get the benefits?

    I’m not sure she can… from the Philippines. There are international laws to consider. It’s like when my parents wanted to have their pensions from the the UK sent to their bank accounts in the Philippines, the British authorities demanded they arrange the request personally in the UK. After that, it was smooth sailing.

    I think the widow has to physically be present in the Netherlands to file claims.

    You have to consider conflicts of laws here. Considering that the wife is a Filipino citizen, the Philippine laws on property regime would apply, but must be reconciled with that of Netherlands. It is important that their marriage should be recognized in both countries, otherwise our laws would only apply to properties located here over which it has jurisdiction, assuming our laws recognize their marriage. If all of the husband’s estate is in his country, i strongly suggest to seek legal advice from a lawyer there.

    My Condolence. Is the Filipina wife a dutch citizen? if so, it’s got nothing to do with Philippine law as she is not a Filipino citizen, she can get the benefit as a widow pensioner or if the husband has life insurance or properties in Netherland she can have part of it if the dead husband has children from previous marriage. If no children involved, it depends, she can have it all if the husband left a WILL that his fiipina wife is the beneficiary. Try to go to Dutch embassy in Philippines and she must speak to the staff face to face not on phone or internet so she will get a very clear information and asked as much as she can , write down all the questions she wants to ask and all the benefits be honest and direct to the point. Bring the marriage certificate (proved legally married) & birth certificate of their own children if any, and I think she have to let the Dutch embassy know that the husband is decease, bring the original copy of death certificate, they will make a copy for it and copy / original of his passport. The reason for this is they will put the record in their database computer system for filing and security reason and in statistics as well.

    She is going to need to hire a lawyer and it is going to cost her money to get the benefits — if she even gets any of them at all. Filipinas should think about things like this before they go off and marry old guys they don’t love. They should demand that he make a will up to make this less complicated. After all, his money was the most important reason that she was with him.
